Terms of Service

Read the Rheovent Terms of Service. Understand the rules, responsibilities, and conditions that govern your access to our marketing automation platform and services.

These Terms of Service ("Terms") govern your access to and use of Rheovent's website, applications, APIs, and related services (collectively, the "Services"). By using the Services, you agree to these Terms.

1) Eligibility and Acceptance

You must be at least 18 years old and able to form a binding contract to use the Services. If you use the Services on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

2) Accounts and Security

You are responsible for:

providing accurate account information,
maintaining the confidentiality of your login credentials and API keys (if any),
safeguarding connected social tokens (including refresh tokens where provided),
all activity that occurs under your account.

You must notify us promptly at [email protected] if you suspect unauthorized access to your account.

3) The Services

Rheovent provides tools for marketing workflows such as drafting content, AI-assisted creation, scheduling, and publishing content to third-party platforms, as well as managing brand assets and related automation features.

We may add, change, or remove features at any time. We will use reasonable efforts to maintain availability, but the Services may be interrupted due to maintenance or events outside our control.

4) Subscriptions, Billing, and Payments

4.1 Plans and Fees

Some features require a paid subscription. Pricing, billing frequency, and usage limits are displayed at checkout and/or in your account.

4.2 Auto-Renewal

Subscriptions automatically renew unless cancelled before the renewal date.

4.3 Payment Processing (Stripe / RevenueCat)

Web subscriptions may be processed by Stripe.
Mobile subscriptions may be managed via RevenueCat, and purchases may be processed through Apple App Store or Google Play, depending on the purchase method.

Payments and billing are also subject to the terms and policies of Stripe, RevenueCat, and applicable platform providers.

4.4 Taxes

You are responsible for all applicable taxes, duties, or government charges associated with your subscription.

4.5 Refunds

Except where required by law or expressly stated in writing by Dynelink LLC, fees are non-refundable. If you cancel, you will retain access through the end of your current paid period.

5) Acceptable Use

You agree not to misuse the Services. You will not, and will not attempt to:

violate any law or regulation,
infringe, misappropriate, or violate intellectual property rights, privacy rights, or publicity rights,
publish, schedule, or distribute content that is unlawful, deceptive, defamatory, harassing, hateful, or otherwise harmful,
distribute malware, attempt to access systems without authorization, or interfere with security,
scrape, reverse engineer, copy, or circumvent usage limits or access restrictions,
use the Services to send spam or for abusive automation.

We may suspend or terminate accounts that violate these Terms or create risk for the Services, our users, or third parties.

6) AI Features and Content Responsibility

The Services may include AI-assisted features (e.g., generating drafts, captions, hashtags, creative suggestions, or other outputs).

You understand and agree that:

AI outputs may be inaccurate, incomplete, offensive, or otherwise unsuitable.
You are solely responsible for reviewing, editing, approving, and verifying content before publishing or using it.
Rheovent does not guarantee outcomes (e.g., engagement, growth, conversions, sales).

The Services do not provide legal, financial, medical, or professional advice.

7) User Content

7.1 Ownership

You retain all rights in content you upload, submit, or create through the Services ("User Content").

7.2 License to Operate the Services

You grant Dynelink LLC a non-exclusive, worldwide, royalty-free license to host, store, process, transmit, display, and otherwise use User Content only as necessary to provide, maintain, and improve the Services, including publishing/scheduling to third-party platforms at your direction.

7.3 Your Responsibilities

You represent and warrant that:

you have all necessary rights to provide User Content,
User Content and its publication do not violate laws or third-party rights,
you have obtained required consents/permissions for any personal data included in User Content.

8.1 Connected Accounts

If you connect third-party accounts (social networks), you authorize Rheovent to:

access and store tokens/permissions (including refresh tokens where provided),
publish and retrieve content and related metadata as configured by you,
perform actions you explicitly authorize through the Services.

8.2 Third-Party Terms and Availability

Your use of third-party platforms is governed by their own terms and policies. Dynelink LLC is not responsible for their practices.

9) Intellectual Property

The Services, including software, interfaces, trademarks, logos, and underlying technology, are owned by Dynelink LLC or its licensors and are protected by intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your internal business purposes during your subscription.

10) Feedback

If you provide feedback, ideas, or suggestions, you grant Dynelink LLC permission to use them without restriction or compensation.

11) Privacy

Your use of the Services is subject to our Privacy Policy, available on rheovent.com. The Privacy Policy describes how we collect and use data, including information associated with connected social accounts.

12) Suspension and Termination

12.1 Suspension

We may suspend access to the Services if we reasonably believe:

you have violated these Terms,
your use creates security, legal, or operational risk,
your account has been compromised.

12.2 Termination

You may stop using the Services at any time. We may terminate your access if you materially breach these Terms or if required to comply with law.

Upon termination:

your right to use the Services ends,
we may delete or de-identify your data in accordance with our Privacy Policy and legal obligations.

13) Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, DYNELINK LLC DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or that AI outputs will be accurate or suitable.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

DYNELINK LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION).
DYNELINK LLC'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO DYNELINK LLC FOR THE SERVICES IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations, so some of the above may not apply.

15) Indemnification

You agree to defend, indemnify, and hold harmless Dynelink LLC and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of:

your User Content,
your use of the Services,
your violation of these Terms or applicable law,
your violation of third-party rights.
